Unauthorized occupancy of University\/College facilities<\/i><\/p>\n or blocking access to or from such areas is prohibited.<\/i><\/p>\n Permission from appropriate college authorities must be<\/i><\/p>\n obtained for removal, relocation, and use of University\/<\/i><\/p>\n college equipment and\/or supplies.<\/i><\/p>\n 4. Theft from, or damage to University\/College premises of<\/i><\/p>\n property, or theft of or damage to property of any person<\/i><\/p>\n on University\/College premises is prohibited.<\/i><\/p>\n 5. Each member of the academic community or an invited<\/i><\/p>\n guest has the right to advocate their position without<\/i><\/p>\n having to fear abuse, physical, verbal, or otherwise, from<\/i><\/p>\n others\u2019 supporting conflicting points of view. Members of<\/i><\/p>\n the academic community and other persons on the college<\/i><\/p>\n grounds shall not use language or take actions reasonably<\/i><\/p>\n likely to provoke or encourage physical violence by<\/i><\/p>\n demonstrators, those demonstrated against, or spectators.<\/i><\/p>\n 6. Disorderly or indecent conduct on University\/Collegeowned<\/i><\/p>\n or controlled property is prohibited.<\/i><\/p>\n 8. No individual shall have in their possession a rifle,<\/i><\/p>\n shotgun, or firearm or knowingly have in their possession<\/i><\/p>\n any other dangerous instruments or material that can be<\/i><\/p>\n used to inflict bodily harm on an individual or damage<\/i><\/p>\n upon a building or the grounds of the University\/College<\/i><\/p>\n without the written authorization of such educational<\/i><\/p>\n institution. Nor shall any individual have in their<\/i><\/p>\n possession any other instrument or material which can be<\/i><\/p>\n used and is intended to inflict bodily harm on any<\/i><\/p>\n individual or damage upon a building or the grounds of the<\/i><\/p>\n University\/College.<\/i><\/p>\n 9. BEAU\u2019S LAW NOTIFICATION GUIDELINES<\/p>\n
These Guidelines are issued in accordance with New York State Education Law
section 6348-d (\u201cBeau\u2019s Law\u201d). Beau\u2019s Law requires an institution of higher learning, such
as The City University of New York (the \u201cUniversity\u201d or \u201cCUNY\u201d), to \u201cmake publicly
accessible its policy on notifying a parent, guardian or emergency contact of a violation
by a student under the age of twenty-one (21) for the use or possession of alcohol or a
controlled substance.\u201d See Beau\u2019s Law \u00a7 6348-d(1). Effective date of Beau\u2019s Law is July
1, 2026.<\/p>\n
Beau\u2019s Law notification guidelines apply to:
All students under the age of twenty-one (21) enrolled at any of the University\u2019s
constituent schools and colleges.
\u22c5 Incidents involving alcohol or controlled substances, whether occurring on campus
or off campus, known to the University.
Incidents Subject to Possible Notification Under Beau\u2019s Law
Pursuant to these Guidelines, incidents involving students under the age of twenty-
one (21) that are subject to possible notification (\u201cSubject Incidents\u201d) include, but are not
limited to:
\u22c5 Violations of University rules or policies involving the use or possession of alcohol
or controlled substances.
\u22c5 Violations of federal, state, and local laws.
\u22c5 Emergencies involving the use or possession of alcohol or controlled substances
including, but not limited to, hospitalizations, overdoses, and other incidents which
pose a serious risk to a student\u2019s health or safety.

Notification Guidelines
Neither Beau\u2019s Law nor these Guidelines require the University to notify a student\u2019s
parent, guardian, or emergency contact of a Subject Incident. Rather, the University may
provide notification on a case-by-case basis after considering the totality of the facts and
circumstances of the Subject Incident and whether notification is permissible and
consistent with the Family Educational Rights and Privacy Act (\u201cFERPA\u201d).
Notification Procedure
Notifications made pursuant to these Guidelines may be made by the Campus
Offices of Student Affairs, Campus Public Safety, Campus Counsel, the Office of the
Senior Vice for Legal Affairs and General Counsel, or any other designated and
authorized individual. If the designee determines that it is necessary to notify a student\u2019s
parent, guardian, or designated emergency contact, any disclosures should include only
the information needed to address the health or safety concerns presented by the Subject
Incident.
Any notifications should also be made in a manner sensitive to, and with respect
for, student privacy. Thus, to the extent possible, a student will be made aware of the
notification, unless doing so is contrary to health and safety or would otherwise
compromise an ongoing investigation. Lastly, any disclosure made pursuant to these
Guidelines must be documented.
Impact On Other Policies
These Guidelines are separate from, and do not modify, any University Policy,
including, but not limited to, the following: the CUNY Policy on Drugs and Alcohol; the
CUNY Drug\/Alcohol Amnesty Policy; the CUNY Policy on Sexual Misconduct; and the
CUNY Students\u2019 Bill of Rights. Moreover, nothing in these Guidelines should be construed
as a limitation on the University\u2019s authority to pursue disciplinary actions under applicable
CUNY Policy or to provide interim and supportive measures as defined under CUNY
Policy.<\/p>\n\n
